These Terms of Service ("Terms") govern access to and use of the website vainom.com (the "Site") operated by VAINOM ("we", "us"). By accessing the Site, the user accepts these Terms.

1. Purpose of the Site
The Site is the official point of reference for the VAINOM project. It allows the user to:
- learn about VAINOM, its features, and its development status;
- download the VAINOM software (Windows binary and Android APK) through links to the official GitHub repository;
- contact the developer.
The Site does not sell goods or services, does not operate e-commerce, and does not collect email addresses for marketing or newsletter purposes.
2. Software Download
Links present on the Site redirect to the official GitHub repository, where the VAINOM software can be downloaded free of charge.
Use of the software is governed by the End User License Agreement (EULA), available in the official GitHub repository at github.com/DVirdis/VAINOM/blob/main/LICENSE.md. Downloading and installing the software implies acceptance of the EULA.
Open-source and redistributed third-party components included in the Software are listed in THIRD_PARTY_LICENSES.md and remain governed by their respective licenses.
We only guarantee the integrity of binaries distributed through the Site's official channels and the official GitHub repository. Copies obtained from other sources are not to be considered trustworthy.
3. Intellectual Property
All content on the Site (texts, logos, images, graphics, code, except where otherwise indicated) is the property of VAINOM and is protected by copyright and other intellectual property laws.
The name "VAINOM" and any associated logos constitute distinctive signs of the project. Their use by third parties without written authorization is not permitted.
4. Prohibited Use
The user agrees not to:
- use the Site for unlawful, abusive, or harmful purposes;
- attempt to gain unauthorized access to the Site or its systems;
- carry out automated scraping, denial-of-service attacks, or other conduct that compromises the availability of the Site.
5. Availability and Changes
The Site is offered "as is" and "as available". We do not guarantee continuous availability, absence of errors, or total security.
We reserve the right, at any time and without notice, to:
- modify, suspend, or terminate the Site or parts of it;
- modify the features offered;
- modify these Terms (the updated version will be published on the Site with a new date of entry into force).
6. Limitation of Liability
To the maximum extent permitted by applicable law, we will not be liable for:
- direct, indirect, incidental, or consequential damages deriving from the use or inability to use the Site;
- loss of data, profits, or business opportunities;
- interruptions, errors, or malfunctions of the Site.
The mandatory statutory rights of consumer users under the Italian Consumer Code and European Union law remain unaffected.
7. External Links
The Site may contain links to third-party websites (e.g., GitHub, Hugging Face). We are not responsible for the content, privacy practices, or policies of such sites. Access to external sites is at the user's own risk.
8. Governing Law and Jurisdiction
These Terms are governed by Italian law.
For disputes arising out of or in connection with these Terms:
(a) if the user is a consumer under Art. 3 of Italian Legislative Decree 206/2005, the competent court is that of the consumer's place of residence or domicile, pursuant to Art. 66-bis of the Consumer Code;
(b) if the user is a business or professional, the Court of Cagliari (Italy) shall have exclusive jurisdiction.
